Dr Beth Upton: Key Figure in Landmark NHS Fife Employment Tribunal
Understanding the Recent Tribunal Ruling
Dr Beth Upton, a doctor working at NHS Fife’s Victoria Hospital in Kirkcaldy, has become a central figure in a significant employment tribunal case that concluded in December 2025. The case has drawn considerable attention due to its exploration of workplace equality issues and the rights of employees under the Equality Act 2010.
Background of the Case
Sandie Peggie was suspended by NHS Fife after complaining about having to share a changing room with Dr Beth Upton at Victoria Hospital in Kirkcaldy, Fife, on Christmas Eve 2023. She was placed on special leave after Dr Upton made an allegation of bullying and harassment, and cited concerns about patient care. The dispute led to an employment tribunal case filed on 3 January 2025 against both NHS Fife and Dr Upton, alleging sexual harassment, harassment related to a protected belief, indirect discrimination, and victimisation under the Equality Act 2010.
The Tribunal Decision
In December 2025, the tribunal ruled that NHS Fife had committed harassment against Peggie by failing to revoke Upton’s changing room permissions after Peggie complained until the two were put on to different rotas; but rejected the claims of discrimination, indirect discrimination, and victimisation. Importantly, all claims against Dr Upton specifically were dismissed.
Significance for Healthcare Workers
This case highlights the complex challenges facing healthcare employers in balancing the rights and dignity of all employees. NHS Fife stated the tribunal had been “a complex and lengthy process” and that their “focus now is to ensure that NHS Fife remains a supportive and inclusive environment for all employees and our patients.” The ruling underscores the importance of employers taking prompt action when complaints arise and ensuring appropriate interim measures are in place while investigations proceed.
